Horn argued that the evidence will not show that Armajo was killed “maliciously and purposely” as the state is required by law to prove. The first witness called to the stand was BB, the alleged rape victim. Through a tearful and emotional testimony, she described the event surrounding the assault.

She said this time Armajo walked her part way home.

Eventually she was able to escape his grasp, and she hid in the neighborhood, BB said. ”I thought I was going to die,” she said. She made contact with law enforcement when she saw the lights at Hereford’s home.

For the defense, BB briefly described Armajo’s voice. She acknowledge that she and him shared a cell phone and that he had it that evening. Horn said phone records reveal a call from that phone to Hereford at 1:06 a.m., after BB said Hereford had already begun his assault on her.

She could not recall any reason the two men would have been angry at each other, but she said she believed Hereford was not having a good time. Horn also said no bloody tissues were found in BB’s bathroom that would have been consistent with her cleaning herself up as she testified.
